In an attempt to ease the housing shortage, the CT legislature enacted a law in 2021 to allow Accessory Dwelling Units in every single family zoned area — like the one in the photo above (at 46 Wright Street, Westport). One study from the nonprofit Regional Planning Association suggests that this statute could help create up to 40,000 housing units over the next 20 years.
By the 12/31/22 deadline, most municipalities in Fairfield County exercised the "opt-out" clause in the state law, to retain local control. In turn, however, many have already taken steps to loosen their rules surround ADUs.
Westport enacted Text Amendment 791 in April 2021 to permit external accessory dwellings up to 650 sq. ft. on lots 1.5 acres or less; 1,000 sq. ft. on larger lots. Conditions include that the property owner must live in the main or accessory residence & leases must be for at least 6 months. Since enactment, Planning and Zoning has approved 20 ADUs, with more in the works, according to Westport Journal.
By increasing the supply of legal rentals, it is hoped that renting will become more affordable. Additionally, this will allow homeowners to "downsize" on their own property if desired and provide rental income.
